JMSN, ‘Love Me’ Artist, Issues Warning to MAGA Inc. Super PAC, Demands Use of Song Cease Immediately

WASHINGTON, D.C. — Attorneys for Christian Berishaj, who performs as JMSN, yesterday evening sent a cease-and-desist letter to representatives at MAGA Inc., demanding the Trump-affiliated Super PAC cancel the planned usage of JMSN’s song “Love Me” in a television ad that has also raised legal questions about the use of taxpayer funds for campaign-style political advertising. JMSN is represented by Democracy Defenders Action, Ballard Spahr LLP and Hecker Fink LLP.

On Oct. 5, President Trump announced via Truth Social that he and his MAGA Inc. Super PAC will pay for the controversial ad campaign going forward rather than using government funds. This is the latest cease-and-desist letter JMSN’s lawyers have had to send regarding use of the song, after an initial letter was delivered to the White House last week. This most recent letter states the administration previously used “Love Me” without JMSN’s permission and without proper licenses or other authorization. JMSN owns the rights to the song. In an Instagram post denouncing the Trump administration’s “The Country He Loves” ad, JMSN said he “would never authorize [his] music to be used for ANY political agenda or campaign.” 

“As we have previously made clear, the use of the song as part of an overtly partisan, political advertisement, is particularly damaging, as it could cause others to call into question JMSN’s artistic independence and integrity,” the letter to MAGA Inc. states.

Further, the letter argues the unauthorized use violates the Lanham Act by falsely suggesting JMSN endorses or is affiliated with the Trump administration. The letter demands that MAGA Inc.:

  • Refrain from any use of the song and any other intellectual property owned by JMSN
  • Immediately withdraw any advertisement that uses the song from all scheduled airings and instruct, in writing, every network, station, cable or satellite provider, streaming service and media buyer carrying the advertisement to stop airing it
  • Remove and take down all online copies of the ad and any other videos or posts containing the song 
  • Provide a written accounting of every airing and posting of any the advertisement, including the date, time, network or station, market, program and total media spend

The letter requests that MAGA Inc. respond with written confirmation by 5 p.m. on Thursday, Oct. 8, that these steps have been taken.
